Terms of Sale

Preamble

The services offered by AEROVISION are governed by the prices in force, the terms of sale and the applicable regulations, which are deemed to form an integral part of these terms. The prices of the services described are expressed with all taxes included. They include a 10% VAT rate (passenger transport).

Boarding passes:

Boarding passes are purchased either by postal mail, online or by telephone, by direct sale in our agency or via an authorized partner. In accordance with the law, in the event of distance selling, you have 15 days to cancel your purchase.
Once the order is confirmed, we will send you a brochure and the final boarding passes by postal mail. These boarding passes entitle you to:

  • Book the date of your flight based on availability. Flights can be booked during the week, as well as on weekends. Passengers contact AEROVISION by telephone (contact details provided on the boarding pass).
  • Reschedule your flight if it is cancelled due to weather conditions (we have strict safety rules).

Insurance – Warsaw Convention – Limitations:

AEROVISION is covered for all commercial passenger flights by an insurance policy taken out with the company “La Réunion Aérienne”. During the flight managed by AEROVISION, passengers are informed that the provisions of the Warsaw Convention may apply.

Notice of limited liability: The carrier’s liability to passengers in the event of death or personal injury is limited to a maximum of 250,000 SDR per person. Baggage is insured up to 1131 SDR/passenger and goods transported up to a limit of 19 SDR/kg. Special insurance conditions can be offered on request.
Payment: Payments must be made by check payable to AEROVISION, credit card, PayPal, cash or bank transfer.
Prices are net with no discounts, excluding any bank charges to be paid by the buyer.
A 30% deposit must be paid at the time of order.

The balance is due, at the latest, at the time of the flight. In the event of late payment, in accordance with Article L441-6 of the French Commercial Code, a flat-rate fee for collection costs of €40 will be payable, as well as compensation calculated on the basis of three times the legal rate in force per day of delay, from the date of the flight taken.

Validity / Postponement and cancellation attributable to passengers:

The boarding passes are valid for one year from the date of issue of the ticket. After this period, the boarding pass is no longer valid.

To reschedule a flight, you must notify us at least 8 days before the flight.
If you notify us less than 8 days before the flight date or fail to show up for the flight, the ticket will no longer be valid and you must still pay any sums owing.

Postponement and cancellation attributable to AEROVISION:

AEROVISION may be required to cancel the flight due to unsafe weather conditions or aviation restrictions imposed by the aviation authorities. The flight may be cancelled just before take-off.
AEROVISION cannot be held liable for the costs incurred by passengers (travel, lodging expenses, etc.).

Minimum conditions for boarding:

Our flights are accessible to all people in good health, except pregnant women and children under 7 years of age.
Passengers must be able to walk without assistance, stand up for 2 hours, squat at 45° for the landing position, climb the steps into a 1.20 m (4 ft) high basket and hold a handle firmly with both hands.
Mobility-impaired passengers must notify us and we will decide on the special measures we can set up to accommodate them. Similar restrictions also apply to people over 75 years of age, anyone who has recently undergone surgery, people with osteoporosis, people wearing a prosthesis and unaccompanied children between 7 and 12 years of age.
If the special measures are insufficient to ensure the safety of these passengers, we may refuse or postpone their flight.
We are not medically qualified, so passengers are required to check with their doctor about whether they can take a balloon flight.

Regulations on board our balloons:

The pilots are in charge of all aspects of the flight, and, as such, have authority over everyone on board. The pilot may at any time decide to disembark any person or cargo presenting a danger to the progress or safety of the flight. The pilot may interrupt the flight at any time for safety reasons.

General conditions: All bookings imply full and complete acceptance of these conditions.

Disputes: In the event of a dispute, the competent court will be the court of Colmar.
